Petition to be Admitted and entered a Law Student

In the Supreme Court of Judicature Easter Term in the 37th year of the Reign of Queen Victoria [May 6, 1874]

To the Honorable the Justices of Her Majesty's Court of Judicature of Prince Edward Island,

The Petition of Charles Edwin Kelly of Fort Augustus in the County of Queens in the said Island

Gentlemen

Humbly Sheweth

That your petitioner
was born at Fort Augustus in the county of Queens on the 26th day of June, A. D., 1851, and attained the full age of 22 years on the 26th day of June A.D., 1873, that his present place of residence is Fort Augustus in the County of Queens and that the name of his father is Francis Kelly, Surveyor-General of the said Island..
That your petitioner is desirous of studying the profession of Law with the intention of obtaining admission as an attorney of the said Court and purposes to article himself to Edward J. Hodgson, Barrister of the Honorable Court.
Your petitioner therefore humbly prays that an order may be made by this Honorable Court for his Examination touching his fitness to enter upon the study of Law in terms of the Act of the General Assembly made and passed in the eleventh year of the Reign of Her Present Majesty intitled "An Act to repeal the Acts for the admission of Barristers, Attorneys, and Solicitors and to make provision in lieu thereof."
And your petitioner is in duty bound will ever pray

I hereby certify that Charles Edwin Kelly, the above petitioner, is a person of sober and temperate habits and that I verily believe him to be a proper person to be admitted a Student at Law.

Francis (illegible, possibly Joseph) Curry (Conroy, or Casey,) born in Tignish, County Prince, August 22, 1856, son of Nicholas Curry (Conroy, or Casey), of Tignish, Prince County; his "present place of residence" was St. Dunstan's College.]

Charles E. Kelly never completed his course of studies. He died Nov. 14th, 1875, aged 27 years, seventh son of Hon. Francis Kelly of Fort Augustus.


Charlottetown, 7 May 1874,

This is to certify that Charles E. Kelly, of Fort Augustus, was by us examined preparatory to his admission as a Law Student in the office of E. J. Hodgson, Esq., pursuant to 11 Vic. Cap 31, and that we are satisfied as to his moral character, good habits and fitness to enter upon the Study of the Law.

ARTICLES of Agreement indented, had made, concluded and agreed upon the sixth day of May in the year of our Lord, one thousand eight hundred and seventy-four in the thirty-seventh year of the Reign of Her Present Majesty, Queen Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen Defender of the Faith.

BETWEEN Edward Jarvis Hodgson of Charlottetown in Queens County in Prince Edward Island, one of the Attorneys of Her Majesty's Supreme court of Judicature and a Solicitor of the Court of Chancery of the said Island of the one part and Charles Edwin Kelly of Fort Augustus in Queens County in the said Island of the other part, WITNESS that the said Charles Edwin Kelly hath put, placed, bound himself and by these presents doth put, place and bind himself Clerk to the said Edward Jarvis Hodgson, to serve him from the day of the date hereof, for and during and until the full end and term of five years thence next ensuing and fully to be completed and ended. And the said Charles Edwin Kelly doth promise, covenant, and agree to and with the said Edward Jarvis Hodgson by these presents in manner following that is to say that he, the said Charles Edwin Kelly, shall and will well and faithfully serve the said Edward Jarvis Hodgson in his profession of an Attorney at Law and Solicitor in Chancery from Friday of the date hereof for and during the said term of five years, and that he, the said Charles Edwin Kelly shall not during the said term of five years cancel, obliterate, spoil, destroy, waste, embezzle, spend or make away with any of the books, papers, writings, moneys or other property of the said Edward Jarvis Hodgson, his executors, administrators or designs or of any of his clients or employers which shall be deposited in his hands, entrusted to his custody or possession or to the care, custody, or possession of him, the said Charles Edwin Kelly,
AND FURTHER, that he, the said Charles Edwin Kelly, shall and will from time to time and at all times during the said term of five years keep the secrets of the said Edward Jarvis Hodgson and readily and cheerfully obey his lawful and reasonable commands and shall not depart or absent himself from the service or employment of the said Edward Jarvis Hodgson at any time during that said term without his consent first obtained but shall from time to time and at all times conduct himself with all due diligence, honesty, sobriety, and temperance.
IN CONSIDERATION whereof and of the sum of three hundred and twenty-five dollars of lawful money of the Dominion of Canada by the said Charles Edwin Kelly to the said Edward Jarvis Hodgson in hand well truly paid at or before the sealing and delivery of these presents (the receipt whereof he, the said Edward Jarvis Hodgson doth hereby acknowledge and of and from the same and every part thereof doth acquit, release, and discharge the said Charles Edwin Kelly, his executors and administrators and every of them forever by these presents) he, the said Edward Jarvis Hodgson for himself, his heirs, executors and administrators doth covenant, promise and agree to and with the said Charles Edwin Kelly by these presents in manner following, that is to say that he, the said Edward Jarvis Hodgson shall and will accept and take the said Charles Edwin Kelly as his clerk and also shall and will by the best ways and means he may or can and to the utmost of his skill and knowledge, teach and instruct or cause to be taught and instructed the said Charles Edwin Kelly in the said practice or profession of an Attorney at Law and Solicitor in Chancery which he the said Edward Jarvis Hodgson now doth or shall at any time hereafter during the said term use or practice
AND ALSO shall and will at the expiration of the said term use his best means and endeavors at the costs and charges of the said Charles Edwin Kelly to cause and prepare him, the said Charles Edwin Kelly to be admitted and sworn an Attorney of Her Majesty's supreme Court of Judicature and Court of Chancery or any other of Her said Majesty's Courts of Law or Equity within the same Island, provided he the said Charles Edwin Kelly, shall have well and faithfully served his said intended Clerkship

AND FURTHER that he the said Edward Jarvis Hodgson shall not nor will within the said term assign or turn over the said Charles Edwin Kelly to any Attorney or Solicitor or to any other person or persons whomsoever without the knowledge, consent or approbation of the said Charles Edwin Kelly or the direction of Her Majesty's Courts aforesaid for the remainder or any part of the aforesaid term.
IN WITNESS whereof the said parties to these presents have hereunto their hands and seals subscribed, and set the day and year first written above.
