This Indenture made the ninth day of
October in the year of our Lord one thousand
eight hundred and forty between William
Frederick Rennie of Saint Johns the Island
of Newfoundland Merchant of the one part
and David Stewart Rennie formerly of the

City of Edinburgh in that part of the United Kingdom of Great Britain and Ireland called Scotland now of Charlotte Town Prince Edward Island and presently residing in Saint Johns aforesaid Gentleman of the other part Whereas David Rennie formerly of Greenock in the County of ______ there after of the City of Glasgow in the county of Lanark in Scotland aforesaid Merchant deceased departed this life on o about the thirteenth day of January in the year of our Lord one thousand eight hundred and twenty three leaving four sons and one daughter him surviving namely the above named David Stewart Rennie party hereto his eldest Son James Gower Rennie late of Saint Johns aforesaid Merchant now deceased his second Son the above named William Frederick Rennie party hereto his third son Robert Rennie late of Charlotte Town aforesaid now of London Gentleman his fourth Son and Janet Emma Rennie formerly of Edinburgh aforesaid now of Charlotte Town aforesaid Spinster his daughter And whereas the said David Rennie deceased was at the time of his Death lawfully seized of and in the absolute state of inheritance in fee simple possession of and in a certain Township lands hereditaments and premises hereinafter described and mentioned situate in Prince Edward Island formerly called Saint Johns in the Gulph of Saint Laurence in North America And Whereas the said David Rennie not having in his life him<<have??>> executed any lawful or valid devises of of the aforesaid Township Land and premises by and by virtue of by an Act of the General Assembly of this Island of Prince Edward Island made and passed in the twenty first year of the Reign of his late Majesty King George the Third and entitled an Act relating to Wills Legacies and Executors

and Executors for the settlement and distribution of the Estates of Intestates they the said David Stewart Rennie Janes Gower Rennie now deceased William Frederick Rennie Robert Rennie Janet Emma Rennie became entitled by the decease of their said ancestor to the said Township Lands and premises in the shares and proportions following That is to say the same into six equal parts or shares being divided the said David Stewart Rennie in two sixth parts or shares the said James Gower Rennie now deceased to one sixth part or share the said William Frederick Rennie to one sixth part or share the said Robert Rennie to one sixth part or share and the said Janet Emma Rennie to one sixth part or share And whereas the said James Gower Rennie deceased having devised his share and interest in the said Township Lands hereditaments and premises to the said Janet Emma Rennie and no division or partition of the aforesaid Township lands hereditaments and premises having yet been made the said William Frederick Rennie now ilands<<???>> sigerf<<???>> of one sixth part or share thereof as aforesaid Now this Indenture witnesseth that for and in consideration of the sum of six hundred and fifty pounds of lawful money of Great Britain by the said David Stewart Rennie to the said William Frederick Rennie in hand well and truly paid on or immediately before the sealing and delivery of these presents the receipt of stritch<<???>> sum of six<<?>> hundred and fifty pounds he the said William Frederick Rennie doth hereby acknowledge and thereof and of and from the same and every part thereof doth acquit release and for ever ductrage<<????>> the said David Stewart Rennie his heirs executors administrators and assigns and every of them by these presents to he the said William Frederick Rennie Hath granted bargained sold aliened released and confirmed and by these presents DO grant bargain sell alien release and confirm unto the said David Stewart Rennie in his actual possession now being by virtue of a bargain and sale for one whole year to him thereof made by the said William Frederick Rennie by Indenture bearing date the day next before the day of the date of these presents and by force of the statements for transferring of uses into possession and to his heirs and assigns he the said William Frederick Rennie one undivided sixth part or share the whole unto six equal parts or shares to be divided of and in all that and those the Township lands in the Island of Prince Edward, formerly called Saint Johns in the Gulph of Siant Laurence in North America marked numbered twenty three in the General Map or survey of the said Island made and taken by public Authority containing an the twenty one thousand Acres more or less situate and being in the parish of of Grenville in the Queens County in the said Island abutted and bounded in the North by the open sea on the South by the division lines numbers 31 and 32 East and West two two Miles and upwards<<??>> on the East by the division Line No. 24 twelve miles in length being the same Township lands and premises which in and by certain letters patent bearing date on or about the fifth day of October one thousand seven hundred and sixty nine under the hand of Walter Patterson Esquire Captain General and Commander in Chief in and over His Majestys and Island of Saint John otherwise called Prince Edward Island and the territories as jaenth<<???>> thereunto and under the Great Seal of the said Island thereunto affixed wore<<???>> granted with one undivided sixth part or share of all timber and woods underwoods ways waters

watercourses easements profits privileges commodities advantages imoluments hereditaments and appurtenances whatsoever to the said undivided sixth part or share of the said Township Lands hereditaments and premises belonging or in any wise appertaining ir therewith or with any part or parcel thereof usually held used accepted enjoyed reputed deemed taken or known as part or parcel or member thereof or of any part thereof and of the revision and revisions remainder and remainders yearly and other rents fruits and profits thereof or of every part and parcel thereof and of all the Estate right title intent trust property claim and demand whatsoever both at Law and in Equity of him the said Frederick Rennie of in to or out of the said premises every or any part or parcel thereof and all deeds conveyances and writings whatsoever in the custody or power of the said William Frederick Rennie which concern or relate to the said premises or any part or parcel thereof solely and alone and true and attested copies of all such other deeds evidences and writings in the custody or power of the said William Frederick Rennie which concern of relate to the said premises or any part or parcel thereof jointly with any other mads hereditaments and which said undivided sixth part or share of the aforesaid lands and premises hereby granted and released or intended so to be contains three thousand five hundred Acres be the same a little more or less To Have and to Hold to the said ones such undivided part or share of the said Township Lands and hereditaments and all and singular other the premises hereby granted and any of their appurtenances unto the said David Stewart Rennie his heirs and assigns to the only proper use and behoof of the said David Stewart Rennie his heirs and assigns fowerver And this Indenture further Witnesseth that for the consideration aforesaid the said William Frederick Rennie Hath granted bargained sold assigned transferred and set over and by these presents Doth grant bargain sell assign transfer and set over unto the said David Stewart Rennie his executors administrators and assigns All his the said William Frederick Rennie share of all and every the Rent and Rents sum and sums of money which for or in respectively of the use occupation or enjoyment of the said Township Lands and premises or any part or parts thereof have accrued and become due and payable from any tenant or tenants person or persons who respectively is or are or have been in the use occupation enjoyment of the same or any part or parcel thereof and of all such sum or sums of money damages or other compensation or satisfaction in the nature or means<<???>> profits or otherwise which for or in respect of such use or occupation or any trespass by any person or persons in or about the same he the said William Frederick Rennie is entitled to have demand recover or receive from any such person or persons respectively as aforesaid or from every person or persons he may heretofore have acted as Attorney or Attorney for the Trustees or for the heirs of the said David Rennie deceased To have and to hold receive take and ~~~ enjoy the said rents sums of money and other the premises hereinbefore assigned or mentioned and intended so to be unto and by the said David Stewart Rennie his executors administrators and assigns for his and their ~~ own propermonies and effects absolutely for ever and for the considerations aforesaid the better enabling the said David Stewart Rennie his executors and administrators assigns to have take reover and receive the said rents sums of money and the obtar<<????>> assigned<<???>>

premises and every part thereof he the said William Frederick Rennie Hath made ordained nominated be constituted and appointed and by these presents Doth make ordain nominate constitute and appoint and in his place and stead part and depute the said David Stewart Rennie his executors and administrators his land and lawful Attornies and Attorney insureable in the name of the said William Frederick Rennie but to and for the use and benefit of the said David Stewart Rennie his executors administrators and assigns to act<<???>> demand and receive the said sum and sums of money rents and other the premises hereby assigned and to sue for and take all other lawful means for the recovery thereof and of every part thereof and for the recovery of mesne<<??>> for of to and other such damages as aforesaid and one or some substitute or substitutes under him or them for all or any of either of the purposes aforesaid to nominate and appoint and the same to revoke and another or others from time to appoint when and as often as he the said David Stewart Rennie his executors administrators or assigns shall think proper the said William Frederick Rennie hereby giving and granting such<??>> the said David Stewart Rennie his executors administrators and Assigns and his or their Substitute or Substitutes hereto hold from and authority in the premises and satisfying allowing and conforming all and whatsoever<<??>> the said David Stewart Rennie the Executors administrators assigns or such substitute Substitutes shall lawfully do or cause to be done by virtue of these presents and the said William Frederick Rennie for himself his heirs executors and administrators doth covenant promise and agree to and with the said David Stewart Rennie his heirs and assigns in manner following that is to day that for and not withstanding any act deed matter or thing whatsoever had made done committed or suffered by him the said William Frederick Rennie or by any person or persons lawfully claiming or to claim by from or under him he the said William Frederick Rennie now at the time of the sealing and delivery of these presents are lawfully and rightfully seized in his demesne is of fee of and in or well entitled to the said undivided and sixth part of the said Township Land & hereditaments and premises hereinbefore mentioned to be hereby granted and released with their and every part of their appurtenances of in and for a sure perfect and absolute and indefeasiible estate of Inheritance in fee simple in possession and that for and notwithstanding any such act deed matter or thing as aforesaid he the said William Frederick Rennie now hath in himself good right full power and lawful and absolute authority to grant release and convey and assure the same with the appurtenances unto the use of the said David Stewart Rennie his heris and assigns in manner and form aforesaid and according to the true intent and meaninbg of these presents and also that it shall and may be lawful to and for the said David Stewart Rennie his heirs and assigns from time to time and at all times hereafter peacably and quietly to enter into have hold use occupy possess and enjoy all and singular the aforesaid hereditaments and premises hereby granted or released or intended so to be with the appurtenances and to receive and take all and singular the rents issues and profits thereof and all arrears thereof to and for the said William Frederick Rennie or any other person or persons who shall or may at any time or times hereinafter lawfully or equitably claim by from or under or in trust for him and

that free and clear and freely and clearly and absolutely acquitted aposerated<<????>> and discharged or otherwise by him the said William Frederick Rennie his heirs executors administrators well and sufficiently saved defended kept harmless and unmodified of from and against all and all manner of former<<???>> and other gifts grants bargains sales Mortgages jointures<<??>> devises uses trusts wills entails statutes or grievances Judgments executions debts and of and from all other acts deeds leases demises titles troubles charges and incumberances whatsoever at any time hereafter<<????>> had made done or suffered by him the said William Frederick Rennie or by any other person or persons whomsoever lawfully claiming or to claim by from or under him or in part for him and further that the said William Frederick Rennie and all and every other person or persons whomsoever who shall or may at at any time or times hereafter trane<<???>> or lawfully claim any estate right title or interest in the aforesaid Township lands hereditaments and premises or any part or parcel thereof by from or under him the said William Frederick Rennie shall and will from time to time and at all times hereafter upon the request and at the costs and charges in the law of the said David Stewart Rennie his heirs and assigns make do acknowledge levy<<??>> suffer and execute or cause or procure to be made done suffered acknowledged levied and executed all such further and other lawful and reasonable acts and deeds and assurances in the law whatsoever for the further more perfect and absolute granting releasing and afirming<<??>> and confirming the same and undivided one sixth share of the said Township lands hereditaments and premises with the appurtenances to the use of the said David Stewart Rennie his heirs and assigns forever and for the better assigning and enabling him or them to recover and secure the said Rents <<crossed out "sums of money and other the premises">> hereby assigned to and for his and their own use and behoof absolutely as by the said David Stewart Rennie his heirs executors administrators or assigns or his or their counsel learned in the law should be reasonably devised advised or required In Witness whereof the said parties to these presents have hereunto set their hands and Seals the day and year first above written
