The Indenture Betwixt William Townshend and John Blue McDonald, Lot 43

This Indenture made the fifth day of August in the year of our Lord One Thousand eight hundred and seven Between William Townshend of Charlotte Town Prince Edward Island Esq. Of the one part and John McDonald of East Parish in the said Island Farmer of the other part. Witnesseth that for and in consideration of the Rents Covenants and Agreements hereinafter reserved mentioned and contained on the part of said John McDonald his executors, administrators and assigns to be paid done and performed he the said William Townshend hath Granted demised lett and to farm lett and by their presents doth Grant demise sell and to farm lett unto the said John McDonald all That Tract proce on parcel of land situated lying and being in the said East Parish and part of Lot or Township number Forth three in the said Island fronting on the Gulf of St. Lawrence Ten Chains bordered on the west by lands in the possession of Donald McPhee Junior on the East by unoccupied Land and extending back on parallel lines due South to such a distance as will include and contain One Hundred Acres of Land together with all appurtenances thereunto belonging To Have and to Hold the said tract piece or parcel of Land and all appurtenances thereunto belonging unto the said John McDonald his heirs, executors administrators and assigns from the first day of November now last past for and during the full end and term of forty two years from thence next ensuring and fully to be complete and under yielding and paying therefore yearly and every year for the first three years of the said term the rent of one Pepper Corn on the first day of November in each year and also yielding and paying yearly and every year for the residue of the Said Term, hereby granted the rent or Sum of Five Pounds lawful money of the said Island in and on the first day of November in every year And the said John McDonald doth hereby for himself, his executors administrators and assigns Covenant promise and agree to and with the said William Townshend his heirs and assigns that the said John McDonald his executors administrators assigns shall and will well and truly pay or cause to be paid unto the said William Townshend his heirs or assigns the said yearly residue rents at the days and times above appointed for payment thereof and also shall and will at the end expiration or other sooner determination of this demise is such shall first happen leave, quit, surrender and deliver up the said premises with appurtenances in good and tenantable repair order and condition unto the said William Townshend his heirs or assigns and the said William Townshend doth hereby for himself his heirs and assigns Covenant and grant to and with the said John MacDonald his heirs executors administrators and assigns that he or they or some one of them duly paying the said yearly reserves the is and performing the Covenants above mentioned shall and may from time to time and at all times hereinafter during the term hereby granted peaceably and quietly have, hold, use occupy possess and enjoy the said premises above described With appurtenances without the let said trouble or eviction of or by the said William Townshend his heirs or assigns or any other person or persons Subject always to the payment of the Quit rents which shall become payable to His Majesty his heirs and successors In Witness whereof the said parties to these presents have hereunto interchangeable set their hands and seals this day and year first above written
