Deed of Release, John Savage MacDonald, Administrator, Estate of William Fisher MacDonald to Lewis John Westaway, (1863, Georgetown Royalty)

This Indenture, made the Twenty seventh day of October in the year of Our Lord One thousand eight hundred and sixty three Between John Savage MacDonald of Georgetown in Prince Edward Island Administrator of the Estate and Effects of William Fisher MacDonald late of the same place, Tanner and Currier deceased of the one part, and Lewis John Westaway of the said place, Master Mariner of the other part.

Witnesseth, that for and in consideration of the sum of Thirty Three Pounds of lawful money of Prince Edward Island, to the said John Savage MacDonald Administrator in hand well and truly paid by the said Lewis John Westaway at or immediately before the Sealing and Delivery of these Presents (the receipt whereof he the said John Savage MacDonald Administrator doth hereby acknowledge,) and of and from the same, and every part thereof, doth acquit, release and discharge the said Lewis John Westaway, his heirs, Executors, Administrators and Assigns for ever, by these Presents he the said John Savage MacDonald Administrator hath granted, bargained, sold, limited, appointed, aliened, released and confirmed, and by these presents, (being a Deed of Release, made in pursuance of an Act of the General Assembly for the said Island, made and passed in the Twelfth year of the Rein of Her present Majesty Queen Victoria, intituled "An Act for rendering a Release as effectual for the conveyance of Freehold Estates, as a Lease and Release by the same parties")

Doth grant, bargain, sell, limit, appoint, alien, release and confirm the said Lewis John Westaway and his heirs and assigns in All that piece track or parcel of land, being on Pasture Lot in the Royalty of Georgetown aforesaid Number One hundred and Seven (107) and bounded on the South East by lot 102, on the North East by lot 108, on the North West by lot 133 and on the South West by a Road, and containing Eight acres, more or less, together with all and every the rights, privileges, easements, advantages, and appurtenances whatsoever land or hereditaments belonging, or in ant wise appertaining, or thereunto now or heretofore holden, used, occupied or enjoyed. To have and to hold the said messuages or tenaments, land or hereditaments, and all and singular other than the premises hereinbefore granted, appointed and released, or expressed and intended so to be, with their appurtenances, unto and to the use of the said Lewis John Westaway, his Heirs and Assigns forever. Subject nevertheless to the Quit Rents to become due, exceptions, reservations, covenants and conditions in the original Grants or Letters Patent of the premises reserved and contained. And the said John Savage MacDonald Administrator doth hereby for himself, his Heirs, Executors, and Administrators, covenant, promise, and agree with and to the said Lewis John Westaway his Heirs and Assigns, in manner and form following, that is to say - That it shall and may be lawful to and for the said Lewis John Westaway, his Heirs and Assigns, from time to time, and at all times hereafter, peaceably and quietly to enter into and upon, and to have, hold, occupy, possess and enjoy the said messuages, lands and other hereditaments hereinbefore granted and released, or expressed and intended so to be with their appurtenances, and to receive and take the Rents, Issues, and Profits thereof, and of every part thereof, to and for his and their proper use and benefit, without the lawful let, suit, trouble, denial, eviction, interruption, claim or demand whatsoever of or by him the said John Savage MacDonald Administrator or his Heirs or Assigns, or of or by any other person, lawfully or equitably claiming or to claim, by, from or under, or in trust for him, them or any of them.
