Last Will and Testament of Angus McLure Jr., (- 1843, Lot 24)

Note: Angus McLure Jr. born in Inverness-shire, Scotland between 1792 and 1793. Son of Angus Mclure and Isabella McKenzie, immigrated to PEI, Canada circa 1794. Married Margaret McLaren between 1825 and 1830 seven children John S. McLure, Roderick McLure , Annie McLure, Job McLure died age 1 month , Hugh McLure ,Euphemia Mclure, Catherine Mclure : Appointed Fence Viewer for Brackley Pt. For 1839 .Died 12, Feb. 1843 ae; 50 years of age. buried at Cavendish. Original in Registry of Probate, Charlottetown. Undated

In the name of God Amen, I Angus McLure of township number 24 , farmer, do make this as and for my last will and testament.

In the first place, I bequeath to my eldest son John, one third part of my real estate being that part bounded on the east by the lands of James Cannon, and to the heirs of his body lawfully to be begotten.

Secondly, I bequeath to my second son Roderick , one third part of my said real estate adjoining that share bequeathed to my said son John and to the heirs of his body lawfully begotten and further, I bequeath to my youngest son Hugh, the remaining third of my said estate and to his heirs lawfully to be begotten. With all the improvements and buildings that are scituate theron which said share shall be subject to the support and maintenance of my dear wife during the term of her natural life or as long as my said wife continues to reside with him and remains unmarried.

And further, that the whole of my gear and personal estate shall remain in the in the sole possession of my said dear wife, until each one of my sons shall separately attain to the age of twenty-one years , and that on each severally attaining such age, he shall be entitled to enter into full possession of his share as above described. And my further will is, that in case of any, or, either of my said sons dying without lawful issue them surviving, the share or division herein before, bequeathed shall become the property of my surviving son or sons in equal proportions and to their respective heirs lawfully issuing.

And I further will, that the foregoing bequeaths be subject to the payment of the sum of fifteen pounds currency to be paid in horses, cattle, or sheep to each of my daughters that shall attain the age of eighteen years or on her being settled in life.

The above requests shall be clear of any deductions on account of any …that may be… dispose ? of my just debts and funeral expenses, which shall be paid out of the personal property I may die possessed of –and further I nominate and appoint my friends Alexander McKenzie Senior of Rustico Capes, David Simpson of Cavendish , Peter Gregor, and Roderick McLure of Brackley Point executors to this my last will and testament.

Signed , sealed, published and declared in the presence of us, who at his request and in his presence and in presence of each other of each other have subscribed our names as witnesses.
