The Land Grant to Andrew Ladner, Lot 65


Grant of Land to Andrew Ladner from Lieutenant Governor Edmund Fanning in Prince Edward Island, Canada.

LOT 65

This indenture made the 23rd day of September in the 37th year of the reign of our Sovereign Lord George the IIIrd by the grace of God of Great Britain, France and Ireland, King defender of the faith and in the year of our Lord seventeen hundred and ninety-six, between his Excellency Edmund Fanning, Lieutenant Governor on the Island of St. John of the one part and Andrew Ladner of the said Island of the other part, witnesseth that the said Edmund Fanning for and in consideration of the sum of Five Shillings by the said Andrew Ladner to him in hand, paid at and before the entailing and delivery of these presents the receipt, whereof the said Edmund Fanning doth hereby acknowledge and thereof for ever exonerate and acquit him the said Andrew Ladner, his heirs, Executors, Administrators and assigns and for diverse other considerations hath granted, bargained, sold, assigned, enfeoffed, released, confirmed and set over and by these present doth grant, bargain, sell, assign, Enpossed, release, confirm and set over unto the said Andrew Ladner, his heirs and assigns, forever all that piece, parcel or tract of land lying, being and situate in the Island of St. John aforesaid part and parcel of lot or Township number sixty-five, fronting on the south in Hillsborough Bay, on the East on Lot number 26 amongst the hundred acre lots and which said piece or parcel of ground hereby released and confirmed is number 27, as may more fully appear on reference to a map or plan of the moiety of the said Township, with the divisions of the one Hundred acre lots laid down thereon in the office of the Surveyor general at Charlottetown and containing in the whole one hundred acres of land be the same more of less, to have and to hold the said one hundred acres of land together with all houses, buildings, improvements, rights, privileges and appurtenances to the same in any ways belonging or appertaining and all the Estate right and title and interest of him the said Edmund Fanning, his Heirs and Assigns of, in and to the same and every part thereof to him the said Andrew Ladner, his heirs and assigns forever. And the Edmund Fanning doth hereby for himself his Heirs and assigns covenant, grant and agree to and with the said Andrew Ladner, his heirs and assigns that the said Edmund Fanning now is soul and lawful owner of the said lands and premises and that he hath full and ample power to sell, convey and make over the same forever free from all claims, rights and encumbrances and further that the said Andrew Ladner, his heirs and assigns shall and may forever hereafter peaceable and quietly have hold, occupy, possess and enjoy the foresaid lands and premises without any set hindrances, molestation, claims, right of dower or encumbrance, whatsoever the rights and quit rents hereafter to grow due and payable to his Majesty, his Heirs, successors, only accepted and foreprised. And the said Edmund Fanning does by those present does oblige himself, his Heirs, Executors and administrators to warrant and defend him the said Andrew Ladner, his heirs and assigns in the quiet and peaceable possession of the said lands and premises, hereby granted from and against him the said Edmund Fanning, his heirs and assigns and all persons claiming by, from or under him or them or either of them and also from and against all manner of possess, whomsoever lawfully claiming or lawfully to claim the said hereby granted land and premises or any part or parcel or right thereof, and further that the will at any time hereafter at the reasonable regret and charges of the said Andrew Ladner, his heirs or assigns make and things, deeds, conveyances and assurances in the law for the better and more effectively securing and protecting the estate right and title of the said Andrew Ladner, his heirs or assigns of, in and to the aforesaid lands and premises forever as by him or them or any of them of his or their or any of their counsel learned in the laws shall be reasonable advised devised or required. In witness thereof the said Edmund Fanning hath hereunto set his hand and seal. The day and year first above written.
