Agreement of Support Between Herbert E. Cantwell & Michael Egan & wife, Dated: May 15, 1911 A.D.

Background:

My grandmother, Florence Genetta Giles, was born around Londonderry, Nova Scotia, in 1885. As a young child her father passed away and she and her sisters were placed in a convent school and the boys went to work. Their mother, Catherine (MacEachern) Giles, stayed with the boys to cook and care of them.

One summer when my grandmother was about 6 - 7 years old, some of the Sisters came to Charlottetown to visit the convent Sisters here. They took my grandmother with them and she was introduced to Michael and Elizabeth Egan, an older couple who were childless. They agreed to take her in as a foster child and raise her although she continued to keep in contact with her mother and siblings quite often.

She eventually met my grandfather, Herbert Edward Cantwell, and in 1908 they were married and they lived on Fitzroy Street. As Michael Egan and his wife were getting up in years they wanted to be sure they would be taken care of in their old age. Michael approached my grandfather and they discussed the matter and the following agreement was drawn up and signed by him.

Between

Herbert E. Cantwell

&

Michael Egan & wife

Dated: May 15, 1911 A.D.

THIS AGREEMENT made the fifteenth day of May in the year of our Lord one thousand and eleven (A.D. 1911) BETWEEN Herbert E. Cantwell of Charlottetown in Queens County, Prince Edward Island, Barber, of the one part, and Michael Egan of Charlottetown aforesaid, Contractor and Elizabeth Egan his wife of the other part:

WHEREAS by two Indentures of even date herewith the said Michael Egan and Elizabeth Egan have severally conveyed and assured to the said Herbert E. Cantwell two certain tracts of land on the west side of Great George Street in Charlottetown, AND WHEREAS on negotiation for the sale of the said lands to the said Herbert E. Cantwell it was agreed that a part of the consideration for the conveyance of the said lands should be that the said Herbert E. Cantwell would maintain support and keep the said Michael Egan and Elizabeth Egan and the survivor of them in sickness and in health.

NOW THIS AGREEMENT WITNESSETH that in pursuance of said agreement and in consideration of the conveyances to the said Herbert E. Cantwell as aforesaid he and the said Herbert E. Cantwell doth hereby for himself his heirs and assigns covenant promise and agree with and to the said Michael Egan and Elizabeth Egan and each of them their and each of their respective executors and administrators as follows, that is to say:- That the said Herbert E. Cantwell his heirs or assigns will at all times hereafter during the lives of the said Michael Egan and Elizabeth Egan and during the life of the survivor of them maintain support and keep the said Michael Egan and Elizabeth Egan and the survivor of them at all times in sickness and in health and provide the said Michael Egan and Elizabeth Egan and the survivor of them with good and sufficient food, clothing, lodging, meat, drink, washing, attendance medical and otherwise, and medicine and generally will maintain the said Michael Egan and Elizabeth Egan and the survivor of them in as full and ample a manner as that in which they have heretofore been maintained and kept and in a manner suitable to their station in life and upon the death of each of them the said Michael Egan and Elizabeth Egan will provide each with a decent Christian burial.

IN WITNESS whereof the said parties to these presents have hereto set their hands and seals.
