Last Will and Testament of Charles Richard Sanderson

In the name of God. Amen. I, Charles Richard Sanderson of Greenwich in Township Number Forty in Kings County, Dominion of Canada, and Province of Prince Edward Island, Farmer, being weak in body but of sound and disposing mind, do make these presents to be and contain my last will and testament, as follows, that is to say, I desire that my body may be buried at the direction of my Executors herein after named, and I direct that all my funeral expenses and just debts, and the charges of proving this my will, be fully paid and satisfied by my Executors out of my personal property as soon as conveniently can be done after my decease; and as to my real estate, the same being comprised of one-third part of five hundred acres of land, a little more or less, situate lying and being in Greenwich in the said Township, County, Dominion and Province of Prince Edward Island, aforesaid mentioned, I give and devise the same, as hereinafter mentioned, that is to say, I give and devise unto my son Robert Garbard Sanderson, the Homestead whereon I now reside, containing in or about one hundred and seventeen acres of land, together with all hereditances and appurtenances thereunto belonging and appertaining, to hold unto him, the said Robert Garbard Sanderson, his heirs and assigns forever; I also hereby give and bequeath unto my said son, Robert Garbard Sanderson, all and singular my personal property of every description whatever, save and except as aforesaid touching my personal estate; It is nevertheless my will and desire, and I do hereby direct and declare that the aforesaid mentioned real and personal estate is devised and bequeathed by me unto my said son, Robert Garbard Sanderson, upon the express condition and consideration that the said Robert Garbard Sanderson shall and will at all times after my decease, provide for, maintain and support my present wife Margaret Sanderson in sickness and in health during the term of her natural life, or until she intermarries, whichever may take place first, and so long as she remains in this dwelling or place of abode, to be found and provided with all necessaries such as she was formally used and accustomed to; she at all times aiding and assisting in and about the management of the house and premises of the said Robert Garbard Sanderson as may be reasonably required by him; the foregoing mentioned stipulations on the part and behalf of my said wife, to be considered and taken by her in lieu of her dower in my said estate or any part thereof and which said stipulations are every part thereof on her part deferring to her maintenance as aforesaid mentioned to become null and void, should she seek for and recover her dower out of my said estate. It is also my will and desire, and I do hereby direct that my said son, Robert Garbard Sanderson, in consideration of the aforesaid mentioned premises being so devised and bequeathed by me to him, he shall and do at all times after my decease find and provide my sons George Sanderson, Stainforth Sanderson and William Howard Sanderson until they do each of them arrive at the age of twenty one years in a comfortable maintenance, the same in all respects as they are now accustomed to so long as they or either of them remain and live with him in his house and dwelling place, they at all times or such one or more of them so residing with him or as aforesaid to assist in the management of the said premises of him, the said Robert Garbard Sanderson, as may be reasonably required by him, and in case of either the said George Sanderson, Stainforth Sanderson, or William Howard Sanderson, or all of them at any time during their minority or after quitting the said residence and premises of the said Robert Garbard Sanderson to pay or cause to be paid unto the said George Sanderson and Stainforth Sanderson each the sum of sixteen dollars, in cash or in farm produce, at the option of the said Robert Garbard Sanderson, and also he to pay to the said William Howard Sanderson, upon his obtaining the age of twenty-one years the sum of ninety-seven dollars in such way and manner last mentioned as aforesaid; and further, I will and desire and do hereby direct that my said son, Robert Garbard Sanderson, in consideration of the aforesaid mentioned premises being so demised and bequeathed by me to him, he shall and do pay, or cause to be paid, unto my daughters, Caroline, Harriet, Theodosia, and Jane, each sixteen dollars as they severally arrive at the age of twenty-one years, or at the time they severally become married or leave residing with him, and also, I direct that my said son, Robert Garbard Sanderson, at all times after my decease furnish and provide for my said four last named daughters, in his house and dwelling place, all the necessaries of life in such way and manner as they are now accustomed to until they severally marry or become of age, and also pay, or cause to be paid to my daughter Sarah, the now wife of Horatio Sanderson, the sum of one dollar current money of the said Island. I give and devise unto my said Executors herein after named, in trust for my said sons George and Stainforth, the western fifty acres of land, being part of my estate on Greenwich aforesaid, the same to be equally divided between them by my said Executors upon my said sons George and Stainforth attaining each the age of twenty-one years, I also order and hereby direct that all legacies, lands and all other thing or things in and by this my said Last Will and Testament, devised, bequeathed or given by me, shall run with the said lands in this my will in whosoever hands the same may come.

I do hereby nominate and appoint George Charles Sanderson and Robert Samuel Sanderson, both of Township Number Forty in the said County, Dominion and Province of Prince Edward Island, Farmers, Trustees and Executors of this my Last Will and Testament, and I do hereby revoke and make void all former and other Will and Wills by me at any time or times heretofore made, and I do declare these presents to be and contain my Last Will and Testament.

In witness whereof, I, the said Testator, Charles Richard Sanderson, have to this my said Last Will, written from four sides of paper, set my hand and seal this Second day of October AD. 1876.

in his presence, at his request, and in the presents
of each other, have hereunto signed and sealed our
names as witnesses.
