The Last Will and Tetament of Donald MacPherson

Note: This will is from the series of typed will books at the Estates Division, and is found at Volume 4, p. 73.

In the Name of God, Amen, I Donald McPherson of Orwell being in a weak state of body but of sound Memory judgment and understanding and considering the shortness and uncertainty of this life do make and ordain this as my last Will and Testament - First Having already left and bequeathed all my landed property consisting of one hundred Acres and situate on Orwell River to my two Grand sons Thomas and John McPherson in Consideration of their affectionate and dutiful Conduct towards me I hereby confirm and ratify the same unto them together with all the stock and Crop on the farm & to their Heirs and Assigns forever. Secondly respecting any money or moveable property belonging to me, I order and bequeath to my son Angus the Sum of Five pounds Nova Scotia Currency and to my two Grand daughters Isabella McPherson and Mary Matheson the sum of six Pounds each Island Currency - And should my Wife Mary McPherson return again from Cape Briton and Choose to live in this Island I order and direct my two Grandsons Thomas and John McPherson aforesaid to maintain and support her during the remainder of her natural life Thirdly I leave and bequeath to each of my remaining Children Viz John McPherson Norman McPherson Ann McIntosh and Effie McLeod The sum of Five shillings each - I order and direct my two Grandsons Thomas and John McPherson aforesaid to maintain and support their nephew Norman McPherson and his family until he himself raises a crop for his maintenance -
I hereby Confirm and ratify the agreement bearing date the twenty first day of August one thousand Eight hundred and Thirty Eight by which I assigned and made over my landed property to my Grandsons Thomas and John McPherson aforesaid and every other Will and Testament I hereby revoke and annul - In witness whereof I have hereunto set my hand and seal This twenty second day of February One thousand Eight hundred and Forty One
