Will of James Sencabaugh of Prince Edward Island (1804-1898)


Submitter’s notes: James Sencabaugh (1804 - 1898) was the seventh child and sixth son of William Sencabaugh, the Loyalist, and his wife Ruhamah Hugh or Hughes. In 1830 he married Charlotte Brehaut (1810 - 1895), a daughter of Henry Matthew Brehaut and Elizabeth Pullem, who had emigrated from Guernsey in 1806.

James’ sons William (twin to Henry) and David apparently died in infancy. Of the four sons who survived to adulthood, three (Henry, John Thomas, and James) moved to Cleveland, Ohio, leaving only Benjamin as heir to the family homestead.

In the name of God Amen. I James Sencebaugh of Murray Harbor South In the Parish of Saint Andrews Kings County in the Province of Prince Edward Island farmer being mindful of my mortality knowing it is appointed unto all men once to die do make and declare this my last Will and testament in manner following.

First I give and devise unto my son Benjamin H. Sencebaugh all those my messuages and tenements with the appurtenances situate lying and being at Murray Harbor South aforesaid consisting of Fifty Acres of Land with all buildings and erections thereon being the homestead on which I now reside To have and to Hold (subject nevertheless to and charged and chargeable with the maintenance clothing and support of my wife Charlotte Sencebaugh as hereinafter mentioned) to him the said Benjamin H. Sencebaugh his Heirs and assigns forever.

And I give and devise unto my said wife Charlotte Sencebaugh for and during the term of her natural life all that part of any dwelling house which my said wife and I now occupy and after her decease the same to become and remain the property of my said son Benjamin H. Sencebaugh his heirs and assigns forever.

Also I give and bequeath to my said wife Charlotte Sencebaugh the beds and bedding and all other furniture that are now in that part of my dwelling house in which my said wife and I now live to and for her own use and benefit absolutely.

Also I give and bequeath unto my said wife Charlotte Sencebaugh for and during her life one cow four Sheep and One dozen hens the said Cow sheep and hens to be housed fed and kept on the said hereinbefore described property by the said Benjamin H. Sencebaugh his Heirs Executors administrators and assigns and after the decease of my said wife the same to become and remain the property of the said Benjamin H. Sencebaugh his Heirs and assigns forever.

And my will is and I do hereby expressly declare that my said son Benjamin H. Sencebaugh his Heirs Executors Administrators or assigns shall and will during the natural lifetime of my said wife the said Charlotte Sencebaugh maintain and Support my said wife in a suitable proper and becoming manner finding and supplying her at all times during her life with good proper and necessary food clothing washing and attendance and all other necessaries whatsoever in sickness and in health fitting and suitable to her age station in life and requirements. And Such as it would be right for her to demand or reasonable to expect and I do hereby charge and subject the said messuages and tenements to and with the said maintainance and Support of my said wife accordingly.

Also the rest and residue of my personal Estate whatsoever and wheresoever and of what nature kind and quality soever the same may be and not hereinbefore given and disposed of (after payment of my debts and funeral expences) I do give and bequeath unto my said son Benjamin H. Sencebaugh his Heirs Executors Administrators and Assigns to and for his and their own use and benefit absolutely.

And I do hereby constitute and appoint my said son Benjamin H. Sencebaugh of Murray Harbor South and Daniel Brehaut of White Sands Executors of this my last will and testament.

In testimony whereof I have hereunto set my hand and Seal and publish and declare this to be my last Will and Testament in the presence of the witnesses named below this twenty ninth day of April in the year of our Lord one thousand Eight hundred and Eighty six.
