Will of John Duffy of Prince Edward Island (- 1890, Fort Augustus)


The Last Will and Testament of John Duffy

Note: John Duffy, the widower of the late Mary Doyle and son of Peter and Bridget Duffy, is one of the original settlers of Fort Augustus, settling there in 1832.

This is the last will and testament of me, John Duffy, at present of Charlottetown in Queens County in Prince Edward Island, formerly of Fort Augustus in the said County and Province, farmer. I give and bequeath to James Quinn son of my daughter, Rachael Quinn, all my real estate and personal property of what nature and kind soever and wherever the same may be situated. To hold the said real estate and personal property with the appurtenances unto the said James Quinn his heirs, executors, administrators and assigns/ according to the nature of the estate thereof absolutely. And it is my wish and desire that the said James Quinn shall not at any time within ten years from the date of my decease sell or dispose of the said real estate to any person whomsoever-

And I do further declare it to be my will that in case the said James Quinn should not be living at my decease that then and in such case the real estate and personal property hereinbefore devised and bequeathed shall come to and be vested to my son, James Duffy his heirs, executors, administrators absolutely- I direct the said James Quinn or the said James Duffy to pay the costs and charges of drawing and recording this my will and to pay into the hands of the Reverend Allan Mc Donald the sum of eight dollars such sums to be paid within two months after my decease and to be a charge upon the property hereby devised until paid. In witness whereof I have hereunto my hand and sealed, subscribed and set this 22nd day of August 1887.

Signed, sealed, published and declared by the said testator as his last will and testament in the presence of us who in his presence and in the presence of each other have hereunto subscribed our names as witnesses the day and year above written the same having first been read over and explained to the testator a Marksman.
