Will of John Johnston of Prince Edward Island (Margate)


Last Will and Testament of John Johnston of Margate in Prince County . I , John Johnston considering the uncertainty of this mortal life and being of sound mind and memory blessed be Almighty God for the same , do make and publish this my last will and testament in manner and form following. My will is that all my just debts and funeral charges shall be by my Executors herein after named be paid out of my estate as soon after my decease as shall by them be found convenient.

I give and bequeath to my beloved wife Ellen Johnston the sum of One hundred dollars, the aforesaid amount shall be in lieu of her dower in my estate, both real and personal.

I give and bequeath to my step son James W Johnston the sum of One dollar.

I give and bequeath to my son Andrew Johnston the sum of One dollar

I give and bequeath to my son Robert Thomas Johnston the sum of One dollar

I give and bequeath to my son John Alexander Johnston the sum of One dollar

which said several legacies or sums of money I will and order to be paid to the said respective legatees within three months after my decease

I further give and devise to my son Andrew Johnston his heirs and assigns, all that Message or tenement situated lying and being in Margate , Township number Nineteen in Prince County with all other freehold or lease hold estate whatsoever of every Nature and Kind whatsoever to hold to him the said Andrew Johnston his heirs and assigns forever, with the understanding that should my son Andrew Johnston died with out a will or intestate the said property shall be divided equal between his Children respectivefully. My real and personal property of whatever Nature and Kind shall be for the use and benefit of my son Andrew Johnston with the following considerations, that he my son Andrew Johnston shall take good care of his Mother, Ellen Johnston while she should live with him. She is to get feed for her hens while she is able to feed them, and when the said Ellen Johnston , the said Andrew Johnston's mother is not able to look after her hens herself, I request that my son Andrew Johnston give to his mother Ellen Johnston One dollar in cash a month while she lives besides her clothes and maintance while living with him the said Andrew Johnston. She is to be treated kindly and keep clean when sick and if his Mother Ellen Johnston should want to go to church or see a friend I request that my son Andrew Johnston shall drive her or see her driven there and back. I request that my wife Ellen Johnston is to do with whatever she wishes or requests with the goods of what ever Kind that there may be in her bedroom and room bed and beding Mats Clothing wheel or reel or anything movable in her own room , her money that may be in her trunk is to put a monument to her grave if she should request it. And lastly as to all the rest and residue and remainder of my personal estate,goods and chattels of whatsoever Nature and Kind I give and bequeath to my said son Andrew Johnston whom I hereby appoint executor with Wm. Henry Hopgood of Kensington of this my last will and testament hereby revolkall former wills made by me.

In witness where of I have hereunto set my hand and seal the fifth day of June in the year of Our Lord one thousand eight hundred and eighty nine.

Note ; This last will and testament of John Johnston ( liber 12 , folio 294 ) was probated Aug 17, 1889, just two months after it's writing. John Johnston's wife Ellen was in fact Helen Woodside.
