The Will of Roderick Cameron (1831-1894, Point Prim/Charlottetown)


WILL OF CAPTAIN RODERICK CAMERON 1831-1894 OF POINT PRIM AND CHARLOTTETOWN

This is the last Will and Testament of me Roderick Cameron of the City of Charlottetown in Queens County in the Province of Prince Edward Island in the Dominion of Canada Master Mariner. I devise all the real estate to which I shall be entitled at my decease and I bequeath the personal estate to which I shall be entitled at my decease and I bequeath the personal estate to which I shall be then entitled to my brother Alexander Cameron of Charlottetown aforesaid Master Mariner and my nephew Angus McDonald of Murray Harbour Road Student of Medicine their heirs executors administrators and assigns respectively upon Trust to sell my real estate together or in parcels and to convey and assign the premises respectively so sold to the purchaser of purchasers thereof and to convert and get in my personal estate, and shall stand possessed of the moneys arising from such sale and conversion. Upon Trust to invest one fourth part thereof and to pay the annual interest or income arising therefrom to my wife during her life or such time as she remains my widow, and upon further Trust to invest one half of the said moneys arising from such sale and conversion and to pay the annual interest or income arising therefrom to my two sons share and share alike until they respectively attain the age of thirty years, and upon Further Trust to invest the remaining one fourth of the said moneys and to pay the annual interest or income arising therefrom to my daughter during her life independently of any husband and her receipt notwithstanding coverture shall be a sufficient discharge. And it is hereby declared that my said Trustees shall after the death or marriage of my said wife stand possessed of the fourth part of the said moneys the interest of which was payable to her Upon Trust to hold the two thirds thereof upon the same Trusts as are herinbefore and hereinafter declared regarding the one half of the said moneys in favour of my two sons and as to the remaining one third the same shall be held by my said Trustees upon the same Trusts as are herein before and hereinafter declared regarding the one fourth of the said moneys in favour of my said daughter. And I declare that my said Trustees shall hold the half part of said moneys the interest of which was payable to my two sons upon Trust after my two sons shall attain the age of thirty years to pay the same over to them share and share alike. I declare that my said Trustees shall after the death of my said daughter stand possessed of the moneys the interest of which she was entitled to receive in her lifetime upon such Trusts as she shall notwithstanding coverture by Will appoint and in default thereof to her issue if any share and share alike and if none then to pay the same to my two sons if living and if dead to their heirs at law. I declare that if either of my said sons shall die under the age of twenty one years leaving issue the share to which such child so dying would be entitled to if living shall go to such issue share and share alike and if but one child to that one absolutely and if either of my said sons shall die over the age of twenty one years and under the age of thirty years leaving issue, the share to which such child so dying would be entitled to if living shall go to said issue in such shares as the child so dying shall by will appoint and in default of any will to such issue share and share alike and if but one child to that one absolutely and in case of no issue to the heirs at law of the child so dying. I declare that the said Trustees shall have the power to postpone the sale of my real estate but from the time of my decease the unsold real estate shall be subject to the trusts hereinbefore declared concerning the said moneys and the rents and yearly produce thereof shall be deemed annual income for the purposes of such trusts and such real estate shall be considered as converted in equity. I appoint the said Alexander Cameron and Angus MacDonald Executors of this my Will. In testimony whereof I have hereunder set my hand this 17th Seventeenth day of May in the year of our Lord One Thousand and eight hundred and ninety one.

Irwin one of the subscribing witnesses
Thereto and on the 23rd day of June 1894
Probate was granted to Alexander
Cameron one of the Executors, the other
Executor Angus MacDonald having
renounced. As Certified by
Richard Reddin Judge of Probate.
