The Will of James McDonald (1795-1849, Brae, Lot 9)

In the name of God Amen

I, James McDonald, farmer of the Brae Lot 9, being sound in mind though feeble in health do make this my last will and testament.

1st Whereas I am possessed of Property (?) I do in the first place bequeath my body to the grave and my soul to my creator.

2nd I order that my just and lawful debts be paid as soon as possible out of my property.

3rd I will devise and bequeath in the event of my beloved wife, Ann McKinnon, getting married after my decease all my right and interest of thirty acres of leasehold land fronting on the Brae Shore the same being a portion of the leasehold farm, which I now occupy with my wife.

4th I will and devise and bequeath (in the event of my wife’s future marriage after my decease) sixty five acres of freehold land and my interest into fifty three acres of leasehold land both being fronting the shore of the Brae, and commonly known by the name of Glebe Land and the adjoining land – now in my possession and occupation together with all my household furniture, house and out houses, farming implements and stock, consisting of one horse, one yoke of oxen, a heifer, a steer, three cows, two calves and twelve sheep, together with all and every other property I now possess or may hereafter possess, unto my sons John McDonald, Roderick McDonald and James McDonald in equal shares between them.

5th (In the event of my wife Ann McKinnon remaining after my decease unmarried) I will, devise, give, and bequeath unto her all my property consisting of Sixty five acres of Freehold land and my right and interest unto eighty three acres of leasehold land fronting on the Brae Shore and commonly known by name of Glebe Land and the adjoining land which I now hold occupy and possess, together with all my household furniture house and out houses, farming implements and stock, consisting of one horse, one yoke of oxen, a heifer, a steer, three cows, two calves and twelve sheep, together with all and every other property I now possess or may hereafter become possessed of leaving in her trust charge and care all my children and allowing her the privilege of distributing the property among them according to their respective merits, and according to her own prudence and discretion.

6th I constitute and appoint as my Testamentary Executors my worthy friends Neil McKinnon and John McKeller (sic) who will see this my last will and testament put into execution.
