The Will of James Lewis Hayden (1815-1892, Lot 50)

Know all men by these presents that I James Lewis Hayden of Township Number Fifty Queen’s County Prince Edward Island farmer being in a sound and disposing state of mind make this my last Will and Testament. Viz.

First, I give and bequeath to my son Lemuel C. Hayden his heirs and assigns, my farm of land on which I now reside on said Township consisting of Sixty two acres of land or thereabouts with the appurtenances to have and hold the same to him the said Lemuel C. Hayden his heirs and assigns forever, together with all my stock chattels and farming implements of which I am now or may hereafter be possessed - Subject to the payment by him to my daughter Isabella Hayden of the sum of Thirty five($35) Dollars Annually, together with the use of one good room or apartment properly furnished with the usual outfit for the same consisting of fuel, bedding and furniture as she may require the same, together with the use of one good cow, provided she remains unmarried and remains on the premises and in the present homestead with my son the said Lemuel C. Hayden.

I also bequeath and hereby order that my wife Margaret Hayden if she survive me be provided for in the following manner-namely- that the said Lemuel C. Hayden support her in a decent and comfortable manner with good and sufficient food, clothing, bedding and fuel, and the use of one good room or apartment for her own use and benefit if required together with the use of one good milk cow during the term of her natural life. I also order and appoint that in the event of a disagreement between her the said Margaret Hayden and any members of the family with whom she may reside, that she be paid by the said Lemuel C. Hayden his heirs or assigns the sum of Forty dollars Annually in Cash. I appoint my friends Peter M. Bourke of Millview Lot 49 and William Forbes of Pisquid Road Lot Forty nine to be the executors of this my last Will and Testament and I hereby revoke and annul all other wills formerly made by me. In witness whereof I have hereunto set my hand and seal this eighteenth day of June in the Year Of our Lord One thousand eight hundred and eighty six.

Signed by the said Testaor James Lewis Hayden in the presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses of this his last Will and Testament the same having been first read over and fully explained to the Testator before signing.

subscribing witness thereof as certified by
Richard Reddin, Judge of Probate.
