Last Will and Testament of Patrick Murphy (-1877, Lot 27)

Dated 14th day of Dec. 1876
Filed March 11 1877

This is the last will and testament of me, Patrick Murphy, of Township Number twenty seven in Prince County in the Province of Prince Edward Island Farmer.

First: My will is that all my funeral charges shall, by my executors hereinafter named, be paid out of my estate as soon after my decease as shall by them be found convenient.

Second: I give devise and bequeath to the Reverend Patrick Doyle of Summerside in Prince County the sum of sixteen dollars currency to be for his sole use and also the further sum of sixteen dollars currency to be used by him in purchasing a set of vestments for Saint Malachi’s Church in township number twenty seven aforesaid.

Third: I give devise and bequeath to Mary Thomas wife of Charles Thomas of Summerside aforesaid the sum of ten dollars currency.

Fourth: I give devise and bequeath to Ann Connors wife of John Connors of Summerside aforesaid the sum of ten dollars currency.

Fifth: I give devise and bequeath to Catherine Strong wife of John B Strong of Summerside aforesaid clerk the sum of one hundred dollars currency to be for her sole use.

Sixth: After the payment of my funeral expenses and the cost of procuring a head stone and the legacies hereinbefore bequeathed I give devise and bequeath to my brother William Murphy of township number twenty seven aforesaid all the rest and residue of my estate real and personal of which I shall die seized or possessed or to which I shall be entitled at the time of my decease to have and to hold the same unto and to the use of the said William Murphy his heirs and assigns for ever lastly---I do hereby nominate constitute and appoint the Reverend Patrick Doyle of Summerside aforesaid and Patrick Delaney watchmaker of Summerside----aforesaid to be the executors of this my last will and testament directing my said executors to pay all my funeral expenses and the cost of procuring a plain head stone for my grave and the legacies hereinbefore given out of any estate in testimony whereof I said. Patrick Murphy have to this my last will and testament subscribed my name and affixed my seal this fourteenth day of December in the year of our Lord one thousand eight hundred and seventy six.

Signed sealed published and declared by the said Patrick Murphy as and for his last will and testament in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses hereto.

  The within will of Patrick Murphy being presented for probate Albert A W Lennan one of the subscribed witnesses hereto made oath that he was present and did see the said testator sign seal and deliver the same and also heard him publish and declare the same as and for his last will and testament and that when he did he was of sound disposing mind and memory according to his deponents best discerning and that he set and subscribed his name as a witness thereto in the said testators presence and that William E Auld set his name hereto as a witness at the same time.
